Copyright & Intellectual Property Policy

Hospiverse India (“Hospiverse”, “we”, “our”, or “us”) respects the intellectual property rights of brands, manufacturers, distributors, suppliers, and all third parties. This policy explains how intellectual property rights are handled on the Hospiverse platform and how rights holders may contact us regarding concerns.

Platform Overview

Hospiverse operates as an independent B2B hospitality sourcing, discovery, and lead-generation marketplace. The platform enables hospitality businesses to discover products, brands, suppliers, and service providers operating in the HORECA sector.

Hospiverse qualifies as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000 (India) and claims the protections afforded to intermediaries under Section 79 of that Act in respect of third-party content hosted on the platform, subject to compliance with the applicable due diligence requirements.

Ownership of Content

All trademarks, service marks, logos, trade names, product names, product images, catalogue images, and other proprietary content displayed on Hospiverse remain the exclusive property of their respective owners. Hospiverse makes no claim of ownership over any such content unless expressly stated.

The appearance of any trademark, logo, brand name, or product on Hospiverse does not imply ownership, endorsement, sponsorship, partnership, authorisation, or affiliation with Hospiverse unless expressly stated in a written agreement.

Sources of Product Information

Product information, specifications, descriptions, images, and related data displayed on Hospiverse may be obtained from one or more of the following sources:

  • Publicly available sources, including brand and manufacturer websites
  • Distributor and supplier catalogues and marketing materials
  • Information submitted directly by registered suppliers or their authorised representatives
  • Publicly accessible trade publications, press materials, or regulatory filings

Hospiverse does not independently verify the accuracy, completeness, or currency of all third-party information. Users are advised to verify product details directly with the relevant brand, manufacturer, or supplier.

Submitting a Copyright or IP Complaint

If you are a copyright owner, trademark owner, authorised representative, or rights holder and believe that content appearing on Hospiverse infringes your intellectual property rights under the Copyright Act, 1957, the Trade Marks Act, 1999, or any applicable law, please submit a written notice to us containing the following information:

  1. Your full legal name, company name (if applicable), and contact details including email address and phone number.
  2. A description of the intellectual property right you claim has been infringed (e.g., registered trademark number, copyright details).
  3. The specific URL(s) or location(s) on Hospiverse where the allegedly infringing content appears.
  4. A clear description of how the content infringes your rights.
  5. A statement that you have a good-faith belief that the use of the content is not authorised by the rights owner, its agent, or applicable law.
  6. A statement that the information in your notice is accurate and, if you are acting on behalf of a rights owner, that you are authorised to act on their behalf.
  7. Your physical or electronic signature.

Incomplete notices may delay our ability to investigate and act. Hospiverse reserves the right to request additional information where necessary.

Our Response

Upon receipt of a valid and complete notice, Hospiverse will:

  • Acknowledge receipt of your complaint within 2 business days.
  • Investigate the matter and determine the appropriate course of action.
  • Where warranted, remove, restrict, disable, or update the relevant content.
  • Notify the content submitter (where applicable) that content has been removed or restricted.
  • Aim to resolve all complaints within 7 business days of receipt of a complete notice.

Hospiverse makes all final determinations regarding content hosted on the platform at its sole and reasonable discretion.

Counter-Notice Process

If you are a supplier or content submitter whose content has been removed or restricted following an IP complaint and you believe the removal was made in error or that you have the right to use the content, you may submit a counter-notice to legal@hospiverse.in containing:

  1. Your full name, company name (if applicable), and contact details.
  2. Identification of the content that was removed and its prior location on Hospiverse.
  3. A statement under penalty of perjury that you have a good-faith belief that the content was removed as a result of a mistake or misidentification.
  4. Your physical or electronic signature.

Hospiverse will review counter-notices and may, at its discretion, restore content if it determines the original complaint was invalid or unsupported.

Misuse of this Process

Submitting false, misleading, fraudulent, or malicious IP complaints constitutes an abuse of this process and may result in:

  • Rejection of the current and future complaints from the same submitter.
  • Reporting to relevant authorities where fraudulent intent is suspected.
  • Legal action for damages, costs, or injunctive relief under applicable Indian law.
